It's kinda both. The Hulk movie was after IM1, but I don't know how long (Tony was, obvious, quite involved with the Avengers Initiative, so some time had to have passed).
The idea that SI could still be making weapons was a huge red flag in my head when I saw those vehicles in use (because I didn't actually see anything besides the SI logo in the beginning of the movie the first time, but I knew they were Stark-designed). Then I thought maybe this was some kind of compromise ... weapons that don't, I don't know, penetrate or explode. Then I just flailed.
This thing could totally be a type of enlarged/enhanced version of that 15-minute-paralyzer gadget.
